Dr. Roslyn Franklin, an Infection Control Consultant with over 10 years of experience, has created the Complete Infection Control Academy Membership ("Membership") to support dental professionals in maintaining compliance and staying updated on infection control practices.
By subscribing to the Membership, you agree to the following terms and conditions ("Agreement"). Please read this Agreement carefully as it is legally binding and contact us with any questions before subscribing.
TERMS AND CONDITIONS
1 ACCEPTANCE OF TERMS
1.1 By subscribing or using the Membership services, you agree to be bound by these terms.
1.2 We may update the terms at any time. Updated terms will be posted on the site.
1.3 Continued use of the Membership constitutes acceptance of updated terms.
1.4 If you disagree with any changes, your remedy is to cancel your subscription.
2 BENEFITS OF MEMBERSHIP
2.1 Members receive a three (3) month subscription of Amalgamate Consulting’s Complete Infection Control Academy Membership.
2.2 Complete Infection Control Academy Membership includes access to the following:
2.2.1 60-minute personal support with Ros Franklin per month (valued at $900 plus GST)
a. this includes ongoing monthly personal consultation, answering any questions on infection control policies and practices up to 60-minute per month,
2.2.2 3-hour Beginner Infection Control Course (valued at $397.00 each plus GST)
a. provided online and pre-recorded for the Member,
b. can be accessed at your convenience through your own login,
c. can be shared and learned with your staff,
d. with an individual Completion Certificates to be provided,
2.2.3 3-hour Intermediate Infection Control Course (valued at $397.00 each plus GST)
a. provide you with a core level competency and increase knowledge in infection control and prevention,
b. provided online and pre-recorded for the Member,
c. can be accessed at your convenience through your own login,
d. can be shared and learned with your staff,
e. with an individual Completion Certificates to be provided,
2.2.4 Live Group Webinar Monthly (valued at $3,600.00 plus GST)
a. provides up-to-date knowledge for you and your staff to be compliant at all times,
b. 1-hour group webinar every month sharing relevant information on infection control updates,
c. includes interviews, question and answer with guest speakers in various health professions,
d. this will be recorded and will be available to all subscribed Members,
2.2.5 Compliance Resource Library
a. includes information gathered over 30 years of expertise in the field,
b. with invaluable cheat sheets, including:
(i) Autoclave record sheet
(ii) IC Policy
(iii) Protocols for sharps injury
2.3 Becoming a member
Registration
2.3.1 You become part of the Amalgamate Consulting’s Complete Infection Control Academy by registering your Membership via the registration process on our website - https://www.amalgamate.com.au/ .
2.3.2 Membership is for three (3) months.
2.3.3 As requested, you must provide accurate, complete, up-to-date Membership registration information. You are required to inform us of any changes to your registration information.
2.3.4 We may request a form of identification to verify your identity anytime.
Password security
2.4 By becoming a Registered Member of this Site, you acknowledge and agree that:
2.4.1 You are solely responsible for protecting the confidentiality of any password or member identification that you may issue to or subscribe to from time to time.
2.4.2 You will not reveal (or cause to be revealed through any act or omission) your password to any other person.
2.4.3 You will notify us immediately if your password is lost or becomes known to anyone else.
2.4.4 You are solely responsible for all access to and use of this Site via your password, whether such access or use is by you or any other person, and
2.4.5 Any information you provide us for posting or inclusion in our online community at any time becomes our property.
2.5 Your personal information to Amalgamate Consulting’s Complete Infection Control Academy will be treated strictly under our Privacy Policy at https://www.amalgamate.com.au/privacy_policy .
3 MEMBERSHIP FEES AND PAYMENT
3.2 The membership fee is payable in advance for a three (3) month subscription period.
3.3 The current Amalgamate Consulting membership fee options are as follows:
a. The 3-month subscription fee is $1,500.00 (exclusive of GST).
3.4 If a member cancels their membership and later wishes to rejoin, they must do so at the then-current membership fee, as advertised on the website.
3.5 All payments are processed through Kajabi Payments, with available payment methods including Google Pay, Apple Pay, Credit Card, and Debit Card.
3.6 Amalgamate does not store credit or debit card details. Kajabi Payments manages all payment-related information in accordance with its Privacy Policy.
3.7 All membership fees are charged in Australian Dollars (AUD).
3.8 Membership fees for Australian residents include GST.
3.9 Amalgamate reserves the right to change membership fees at any time without prior notice. Members are advised to check the website for the latest fee updates.
3.10 Existing members will receive 30 days notice of any changes to membership fees. For the duration of their active membership, their fees will remain locked at the original rate. However, if a member cancels and later rejoins, they will be subject to the then-current fee.
3.11 Unless otherwise specified, all prices for goods or services offered on our website include GST, where applicable.
4. CONTENT AND DELIVERY
Content
3.3 Content is updated monthly.
3.4 Content is available to the Member for the duration of the Membership subscription.
3.5 Upon cancellation, access to Content will cease to be available after the last day of the billing cycle of the month of cancellation.
Delivery
3.6 The primary delivery method for Content is through our website and Microsoft Teams or Zoom.
3.7 Learning modules and source documents are available via PDF downloads.
3.8 All live coaching is via Microsoft Teams or Zoom, and replays are available on the website.
4 MEMBER OBLIGATIONS
4.1 Conduct
4.1.1 When using our Services, including any Facebook groups or forums (Online Community), you may post comments, photos, or other material (Your Content). You agree that Your Content will not:
a. Be unlawful, misleading, abusive, defamatory, obscene, harassing, or otherwise objectionable.
b. Degrade or discriminate against others based on religion, gender, sexual orientation, race, ethnicity, age, or disability.
c. Include personal or identifying information about others without their consent.
d. Promote competing products or services unless expressly permitted.
e. Impersonate any person or entity.
4.2 By posting Your Content, you:
a. Grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, edit, and reproduce it for any purpose and
b. Warrant that you have the right to grant this license and that Your Content complies with these Terms and
c. Consent to acts that may infringe your moral rights and warrant that any third party with moral rights in Your Content has given similar consent.
4.3 Roslyn Franklin reserves the right to:
a. Review, modify, or remove any content that breaches these Terms or may harm others.
b. Monitor site usage and disclose information as required for compliance with laws or investigations.
4.4 You agree not to:
a. Contact individuals who have requested no contact or collect personal data for commercial or unlawful purposes.
b. Infringe others' privacy or intellectual property rights.
c. Post anything containing harmful code (e.g., viruses).
d. Use automated tools or processes to access the site or its data.
4.5 You are responsible for dedicating sufficient time and resources to use the Membership’s resources and training effectively.
5 DISCLAIMER
5.1 The information, training, and resources provided through the Amalgamate Consulting’s Membership (Services) are designed to support health professionals in improving their knowledge of infection control practices. However, by participating in this Membership, you acknowledge and agree to the following:
5.1.1 General Information Only
The content provided within the Membership, including training materials, resources, and any advice, is for general informational purposes only. It is not intended to serve as a substitute for professional advice, including but not limited to legal, medical, or regulatory advice specific to your profession, region, or workplace.
5.1.2 No Guarantees or Warranties
Amalgamate Consulting and its representatives make no representations, guarantees, or warranties, expressed or implied, that the information provided is complete, accurate, up-to-date, or suitable for any specific purpose. Although we strive to ensure the reliability of the materials, infection control regulations and standards may change, and it is your responsibility to stay current with any new requirements in your practice area or jurisdiction.
5.1.3 Professional Responsibility
The information and training offered through the Membership are intended as supplementary resources. You remain fully responsible for ensuring compliance with all applicable laws, regulations, and professional guidelines related to infection control and patient care. The training provided is not intended to replace formal professional education or the requirements of regulatory bodies or employers.
5.1.4 No Liability for Actions Taken
Amalgamate Consulting, Roslyn Franklin, and any associated entities or personnel shall not be held liable for any damages, direct or indirect, arising from the use or misuse of the information, resources, or training provided through the Membership. This includes, but is not limited to, any failure to prevent infection, compliance issues with local health regulations, or harm resulting from the application or reliance on the information provided.
5.1.5 No Professional Relationship
Participation in the Membership does not establish a professional-client relationship between you and Amalgamate Consulting or any of its representatives. The Services provided are educational in nature and do not replace independent professional judgment or consultation with qualified professionals.
5.1.6 Third-Party Resources
a. The Membership may include links to third-party websites, services, or resources, including Kajabi Payments. These are provided for convenience and reference only.
b. Amalgamate Consulting does not endorse, control, or assume responsibility for the accuracy, availability, or legality of third-party content or services.
c. Your use of third-party services is subject to their respective terms and conditions.
5.1.7 Use of Membership Content
The materials provided through the Membership, including but not limited to any written, visual, or audio content, are for personal, non-commercial use only. You may not reproduce, distribute, modify, or exploit the content for commercial gain without express written consent from Amalgamate.
5.1.8 Medical Disclaimer
The information provided within the Membership does not constitute medical advice. Health professionals using this Membership must exercise their clinical judgment and follow their professional standards, regulatory requirements, and workplace protocols when applying any infection control measures learned from the Membership content. For specific medical or regulatory advice, consult an appropriate professional.
6 REFUNDS
6.1 Refunds are not provided for membership fees or services provided by us where you have been given access to Our Content or our Online Community, whether accessed by you or not, unless we breach the Australian Competition and Consumer Act 2010.
7 CANCELLATION
12.7 You may cancel your Membership at any time via your online account.
8 RIGHT TO TERMINATE
12.7 We reserve the right to terminate your use of the Site, Online Community or our Products and Services generally if you breach these terms, including conduct, as determined by us in our sole discretion.
9 INTELLECTUAL PROPERTY AND CONTENT USE
9.1 All materials on this Site, in any online community associated with this Site, or delivered to Members (including but not limited to videos, templates, PDFs, and live recordings) (Our Content) are protected by copyright and other intellectual property laws.
9.2 You may browse, download, or print Our Content for non-commercial, personal, or internal business use only. Any other use, reproduction, or distribution for commercial purposes requires our prior written consent.
9.3 Modifying, adapting, or altering Our Content for any purpose other than personal or internal business use without permission is prohibited and constitutes a violation of our copyright and proprietary rights.
9.4 You acknowledge that using this Site or Our Content does not grant you any ownership rights over Our Content or intellectual property.
9.5 The trademarks, logos, and service marks displayed on the Site are the exclusive property of Roslyn Franklin, whether registered or unregistered. 9.7 You agree that any breach of these Terms may cause irreparable harm to Roslyn Franklin, and monetary damages may be insufficient. Therefore, we reserve the right to seek injunctive relief to prevent unauthorised use or violations of our intellectual property rights.
10 LIABILITY IS LIMITED
10.1 The disclaimers, liability limitations, and indemnities within these Terms do not exclude your rights from those under Australian Consumer Law.
10.2 Roslyn Franklin is not responsible for and accepts no liability for Content uploaded, posted, transmitted, or otherwise made available on the Site by anyone other than us.
10.3 Roslyn Franklin will not be taken to have uploaded, posted, transmitted, or otherwise made the Content available on the Site simply by facilitating others' posting, transmitting, or otherwise making Content available.
10.4 Roslyn Franklin does not endorse any opinion, advice or statement from anyone other than us.
10.5 You agree that we will not be liable for any loss or damage that you incur as a result of the use of this Site, including, without limitation, damage caused by access delays, computer viruses, system failure or malfunction that may occur in your use of the Site or Online Community including a hyperlink to or from third-party websites.
11 INDEMNITY
11.1 You agree to indemnify and hold us harmless from any claims, demands, liabilities, costs, expenses, losses, or damages (including legal fees on a full indemnity basis) arising from your use or misuse of our information, products, or services, or any breach of these Terms by you or your agents.
11.2 We are not liable for any damages or losses arising from your use of, or reliance on, any information provided through our Site, Online Community, or membership services.
12 ASSIGNMENT
12.1 Transfer or assignment of your Membership for any reason is not permitted under this Agreement.
13 DISPUTE RESOLUTION
13.1 If you have a concern, please contact [email protected] as soon as possible to seek a resolution through friendly discussion.
13.2 Roslyn Franklin will attempt to resolve any escalated dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.
14 APPLICABLE LAW
14.1 These Terms are governed by, and construed in accordance with the laws of the State of Western Australia, Australia.
14.2 You agree to submit to the exclusive authority of the courts of Victoria for the resolution of any disputes or claims arising out of or in connection with these Terms or your use of the services provided by Roslyn Franklin.
